Conditions of Entry

These Conditions of Entry apply to participation in the Spitfire Scramble (“the Event”), organised by Urban Mud Events Ltd.

Please read these Conditions carefully before entering. By entering the Event, you agree to be bound by these Conditions of Entry and the Event Rules applicable to the relevant edition of the Event.

1. DEFINITIONS AND AGREEMENT

 

1.1 In these Conditions:

“Agreement” means the agreement between you and Urban Mud Events Ltd comprising these Conditions of Entry and the Event Rules.

 

“Event” means the Spitfire Scramble 24-hour endurance running event organised by Urban Mud Events Ltd.

 

“Event Date” means the date or dates announced by us for the relevant edition of the Event.

 

“Event Director” means the person appointed by us with overall operational responsibility for the Event or any person authorised to act on

their behalf.

 

“Event Rules” means the rules, instructions and event-specific conditions published by us for the relevant edition of the Event, including rules relating to teams, laps, timing, equipment, camping and participation.

 

“Fee” means the entry fee and any applicable booking or administration charges payable in connection with your entry.

 

“Participant” means an individual registered to participate in the Event, whether as a solo participant or member of a team.

 

"Purchaser" means the person who purchases and pays for an entry, whether for themselves or for one or more other Participants. The Purchaser holds any financial rights arising from that purchase, including any refund or credit which may become payable in respect of the entry, unless otherwise expressly provided.

 

“Team Captain” means the person responsible for initially registering or administering a team entry.

 

“Venue” means the Event site and any land, routes, camping areas, parking areas or facilities used in connection with the Event.

 

“we”, “us” and “our” mean Urban Mud Events Ltd.

 

“you” and “your” mean the Participant.

 

1.2 By completing or accepting an entry to the Event, you agree to be bound by the Agreement.

 

1.3 You must also comply with all reasonable instructions issued by us, the Event Director, Event officials, marshals, medical personnel, security personnel, the landowner or emergency services.

 

1.4 If there is any conflict between these Conditions and the Event Rules, these Conditions shall take precedence unless the Event Rules expressly state otherwise.

2. ENTRY AND ELIGIBILITY

2.1 Participation is permitted only to individuals who are properly registered for the Event.

 

2.2 You may not participate using another person’s entry, race number, timing chip or identity.

 

2.3 Race numbers and timing devices may not be transferred, exchanged or given to another person except through an official transfer or substitution process authorised by us.

 

2.4 We may establish age restrictions, entry limits, qualification requirements or other eligibility criteria within the Event Rules.

 

2.5 You are responsible for ensuring that all information provided during registration is complete and accurate.

 

2.6 We may refuse or cancel an entry where we reasonably believe that:

• false or materially misleading information has been provided;

• the entry has been obtained in breach of these Conditions;

• a person is attempting to participate under another person’s identity; or

• allowing the person to participate would create an unreasonable safety or operational risk.

 

2.7 Entry to the Event is personal to the registered Participant and is subject to any transfer, substitution or deferral policy published by us.

3. TEAM ENTRIES

3.1 Participants may enter the Event in such solo and team categories as are specified in the Event Rules.

 

3.2 A Purchaser may purchase an entry for themselves or purchase places for one or more other Participants.

 

3.3 A Team Captain may administer a team entry, including managing team membership and requesting permitted substitutions or other administrative changes in accordance with the Event Rules.

 

3.4 The Purchaser, Team Captain and Participant may be the same person or different people.

 

3.5 Regardless of who purchases or administers an entry, every adult Participant must personally accept these Conditions of Entry and the Event Rules before participating in the Event.

 

3.6 A Purchaser or Team Captain cannot accept on behalf of another competent adult Participant any personal obligation, medical provision, acknowledgement of risk or other provision relating to that Participant's participation in the Event.

 

3.7 No person will be permitted to participate unless they have:

• been properly registered as a Participant;

• provided the Participant information reasonably required by us;

• personally accepted the Conditions of Entry and Event Rules; and

• acknowledged the Privacy Notice.

 

3.8 A Team Captain is responsible for ensuring that team members receive relevant Event information supplied to the Team Captain for distribution. This does not replace our right to communicate directly with individual Participants where appropriate.

 

3.9 Team composition, minimum and maximum team sizes, substitution deadlines and eligibility for results, prizes and awards shall be

determined by the Event Rules.

 

3.10 Participants must not exchange race numbers or timing devices between team members except where expressly permitted by the Event Rules or authorised by an Event official.

 

3.11 Where an entry has been purchased by a Purchaser on behalf of another Participant or a team, any financial rights relating to the payment, including any refund or credit which becomes payable, will belong to the Purchaser unless we expressly agree otherwise.

 

3.12 A Participant who did not purchase their own entry will not ordinarily be entitled to require us to make a refund or other payment directly to them in respect of an entry paid for by another person.

 

 

4. PARTICIPANT RESPONSIBILITIES AND FITNESS

4.1 The Spitfire Scramble is an endurance running event which takes place over an extended period and includes running during both daylight and darkness.

 

4.2 You acknowledge that participation involves physical exertion and inherent risks associated with endurance running and outdoor activity.

 

4.3 These risks may include, without limitation:

• slips, trips and falls;

• uneven, loose, muddy, wet or slippery surfaces;

• tree roots, vegetation and other natural or man-made obstacles;

• darkness and reduced visibility;

• heat, cold, rain, wind and other weather conditions;

• fatigue, exhaustion and dehydration;

• interaction with other Participants, spectators and members of the public;

• insects, animals and wildlife;

• natural and environmental hazards; and

• other risks ordinarily associated with trail and endurance running.

 

4.4 You are responsible for deciding whether you are sufficiently fit, healthy and appropriately prepared to participate.

 

4.5 If you have any doubt about your ability to participate safely, you should seek appropriate medical advice before taking part.

 

4.6 You must not participate while knowingly suffering from an illness, injury or medical condition where participation would create an unreasonable risk to yourself or others.

 

4.7 Nothing in this section removes or limits any duty or liability which cannot lawfully be excluded or restricted.

5. SAFETY AND EVENT INSTRUCTIONS

 

5.1 Your safety and the safety of others are paramount.

 

5.2 You must comply promptly with all reasonable instructions given by the Event Director, officials, marshals, medical personnel, security

personnel, landowner representatives or emergency services.

 

5.3 We may prevent you from starting or continuing if we reasonably consider that:

• you are medically unfit to participate;

• continuing may pose an unreasonable risk to your health or safety;

• your conduct poses a risk to another person;

• you do not have equipment required under the Event Rules;

• you appear to be materially impaired by alcohol or drugs; or

• you have failed to comply with a safety instruction.

 

5.4 A decision made in good faith on immediate health or safety grounds may be made without prior warning.

 

5.5 Where suitably qualified medical personnel advise us that allowing you to start or continue participating would present an unreasonable risk to your health or safety, we may prevent you from starting or require you to cease participation in the Event.

 

5.6 A decision by us to prevent you from starting or continuing under clause 5.5 relates solely to your permission to participate in the Event. It does not require you, as a competent adult, to consent to any medical examination, assessment or treatment.

 

5.7 Nothing in these Conditions constitutes advance or blanket consent by you to medical examination or treatment.

 

5.8 Where a Participant is unable to provide or withhold consent during a genuine medical emergency, any examination or treatment will be governed by applicable law, including the Mental Capacity Act 2005 where applicable.

 

 

6. NIGHT RUNNING AND EQUIPMENT

6.1 Parts of the Event take place during darkness or conditions of reduced visibility.

 

6.2 During periods specified by us, Participants must carry and use a functioning headtorch or other lighting equipment approved by us, which may include but is not limited to: a chest-mounted torch or handheld torch

 

6.3 We may specify additional mandatory or recommended equipment within the Event Rules or Participant Guide.

 

6.4 You are responsible for ensuring that your equipment is suitable, properly maintained and sufficiently charged or supplied with batteries.

 

6.5 We may prevent a Participant from entering or continuing on the course without required equipment.

 

6.6 You must not use equipment which, in our reasonable opinion, creates an unreasonable risk or materially interferes with other Participants.

7. THE COURSE AND EVENT FORMAT

7.1 The Event is intended to take place substantially in accordance with the format, course and timings published by us.

 

7.2 However, outdoor endurance events are inherently subject to changing conditions.

 

7.3 Where we reasonably consider it necessary for safety, operational, environmental, land-management or other material reasons, we may:

• alter the Event course;

• shorten or lengthen the course;

• remove or replace a section of the course;

• change the start or finish location;

• change the Event start time;

• change the Event finish time or duration;

• delay the start;

• temporarily suspend participation;

• neutralise part of the Event;

• restrict access to part of the Venue;

• introduce additional safety measures;

• change the Event format; or

• bring the Event to an early conclusion.

 

7.4 Circumstances which may lead to such action include, without limitation:

• extreme heat or cold;

• fire or wildfire risk;

• severe weather;

• flooding;

• high winds;

• lightning;

• unsafe ground conditions;

• environmental concerns;

• an emergency or serious incident;

• loss of access to land or part of the course;

• instructions from the landowner, local authority, police, fire service, ambulance service or another competent authority.

 

7.5 Any decision under this section will be made having regard to Participant safety and the reasonable operational requirements of the Event.

 

7.6 Reasonable modifications

Where reasonably necessary for safety, operational, environmental, land-management or other material reasons, we may make reasonable modifications to the Event in accordance with clause 7.3.

 

A reasonable modification may include, for example, a course diversion or shortening, alteration to part of the route, delay to the start, temporary suspension of the Event, restriction on participation during particular conditions or another proportionate safety or operational measure.

 

A modification will not, solely because it temporarily affects the course, timetable, duration or manner in which the Event is conducted, constitute a material alteration where it is a reasonable and proportionate response to the circumstances and does not, taking the Event as a whole, materially alter its essential nature.

Where the Event proceeds subject to such a reasonable modification, no refund or other financial remedy will ordinarily be payable solely as a result of that modification.

7.7 Material alterations

A modification will constitute a material alteration where, taking into account the Event as a whole, it substantially changes the essential nature of the Event as it was described at the time of entry.

 

In determining whether an alteration is material, regard will be had to the nature, extent and duration of the change, the circumstances giving rise to it, whether the change is temporary or permanent, and its effect on the Event's principal characteristics.

 

Where a material alteration is made before the Event commences and a Participant consequently chooses not to participate, the Participant will be entitled to a refund of the entry fee paid. We may offer a transfer, deferral, credit or other reasonable alternative, but the Participant will not be required to accept that alternative instead of a refund.

 

Where a material alteration occurs after the Event has commenced, any financial remedy to which a Participant is entitled will reflect the nature and extent of the alteration and the Event services already provided, subject always to the Participant's statutory rights.

 

7.8 Participant rights

Nothing in this section excludes, restricts or affects any statutory rights a Participant may have under the Consumer Rights Act 2015 or other applicable law.

 

 

8. EMERGENCIES, SUSPENSION AND EVACUATION

8.1 In an emergency we may suspend or stop all or part of the Event without notice.

 

8.2 Participants must immediately comply with instructions relating to:

• stopping participation;

• evacuation;

• fire;

• severe weather;

• missing persons;

• medical emergencies;

• emergency vehicle access;

• closure of part of the course;

• movement to a place of safety; or

• any other emergency procedure.

8.3 You must not enter a closed or restricted area or continue running after being instructed to stop.

8.4 Failure to comply with an emergency instruction may result in immediate disqualification and removal from the Event.

 

9. MEDICAL ASSISTANCE

9.1 We will make arrangements for medical support at the Event informed by an Event-specific risk assessment and medical needs assessment, taking into account the nature, location, duration and anticipated conditions of the Event and in consultation with our appointed medical service provider(s).

 

9.2 In planning medical and emergency arrangements, appropriate consideration will be given to the nature of the Event as a continuous 24-hour endurance event, including periods of overnight activity, and to reasonably foreseeable risks and emergency response requirements.

 

9.3 Event medical personnel may offer to assess you where there is reasonable concern about your health or wellbeing. Nothing in these Conditions requires a competent adult to consent to a medical examination or treatment.

 

9.4 Where reasonably necessary in an emergency, medical personnel may arrange for further assistance or transportation to an appropriate medical facility. Any medical examination or treatment will be subject to applicable law concerning consent and emergency treatment.

 

9.5 You are responsible for providing accurate emergency contact information and any relevant medical information requested through the registration process and for updating us where information materially relevant to your safe participation changes before the Event.

 

9.6 Information relating to your health will be processed in accordance with our Privacy Notice and applicable data protection law.

 

9.7 Nothing in these Conditions transfers to Participants our responsibility to make appropriate arrangements for the safe planning and delivery of the Event.

10. CONDUCT

10.1 Participants must behave responsibly and with reasonable consideration for others.

 

10.2 We will not tolerate:

• threatening or abusive behaviour;

• violence;

• harassment;

• discriminatory conduct;

• deliberate intimidation;

• dangerous or reckless behaviour;

• deliberate damage to property;

• serious disruption of the Event; or

• abuse of Event staff, volunteers, contractors, Participants, spectators or members of the public.

 

10.3 We may disqualify or remove any person whose conduct we reasonably consider to be in serious breach of this section.

 

10.4 In cases of serious misconduct, we may refuse that person’s entry to future events organised by us.

11. THE VENUE, CAMPING AND ENVIRONMENT

11.1 Participants and their supporters must respect the Venue and surrounding environment.

 

11.2 Camping is permitted only in areas designated by us and subject to the Event Rules.

 

11.3 Participants must comply with rules relating to:

• camping;

• vehicles and parking;

• fires, BBQs and cooking equipment;

• generators and electrical equipment;

• alcohol;

• noise;

• waste disposal;

• toilets and sanitation;

• restricted areas; and

• protection of wildlife and the environment.

 

11.4 You must not deliberately damage vegetation, fencing, signs, structures or other property.

 

11.5 Littering is prohibited.

 

11.6 You must not deliberately leave the marked course except where necessary for safety or as directed by an Event official.

 

11.7 Participants are responsible for the reasonable behaviour of guests or supporters attending specifically as part of their support group.

 

11.8 We may require a person to leave the Venue where they seriously or repeatedly breach Event or Venue rules.

 

12. TIMING, RESULTS AND AWARDS

12.1 Timing arrangements, lap-counting procedures, team requirements and eligibility for official results and awards will be set out in the Event Rules.

 

12.2 Participants are responsible for using any timing equipment supplied by us in accordance with our instructions.

 

12.3 We may amend results where we reasonably believe that a timing, recording or administrative error has occurred.

 

12.4 We may disqualify laps or results obtained in breach of the Event Rules.

 

12.5 Our decision regarding Event results and sporting eligibility shall be final, subject to correction of a demonstrable error.

13. WITHDRAWAL, TRANSFERS AND DEFERRALS

13.1 Entry fees are subject to the withdrawal, transfer, substitution and deferral policy published for the relevant edition of the Event.

 

13.2 Unless expressly stated otherwise in that policy, an inability to participate due to personal circumstances does not automatically entitled to a Participant to a refund.

 

13.3 We may permit official transfers, substitutions or deferrals subject to deadlines, administration charges and eligibility requirements.

 

13.4 Unauthorised transfer or resale of an entry is prohibited.

 

13.5 Any entitlement to a deferral applies only in accordance with the published deferral policy and should not be assumed to apply automatically to subsequent editions of the Event.

14. CANCELLATION OF THE EVENT

14.1 We may cancel the Event where circumstances outside our reasonable control make it impossible, unsafe or unreasonable to stage it.

 

14.2 Such circumstances may include, without limitation:

• severe or dangerous weather;

• fire or wildfire;

• flooding;

• epidemic or pandemic;

• terrorism or credible security threat;

• war or civil disorder;

• failure or withdrawal of essential infrastructure;

• loss of access to the Venue;

• action or instruction by a landowner, local authority, emergency service, government body or other competent authority; or

• another circumstance outside our reasonable control which materially affects our ability to stage the Event safely.

 

14.3 Where practicable, we will communicate cancellation to Participants using the contact information held by us and/or our official communication channels.

​

14.4 Cancellation before the Event

Where we cancel the Event before it has commenced and before meaningful performance of the Event services has taken place, Participants will ordinarily be entitled to a refund of the entry fee paid, subject to their statutory rights.

 

14.5 Transfer or deferral as an alternative

Where appropriate, we may offer Participants the option to transfer or defer their entry to a future edition of the Event, or another reasonable alternative, instead of receiving a refund. The terms of deferral can be found here.

 

Any such alternative will be optional. A Participant will not be required to accept a transfer, deferral or credit in place of a refund where they are legally entitled to a refund.

14.6 Cancellation or abandonment after the Event has commenced

Where the Event has commenced but is subsequently cancelled, abandoned or brought to an early conclusion because of circumstances outside our reasonable control, we will consider what services have already been provided and the nature and timing of the cancellation or abandonment.

 

Where a Participant is entitled to a financial remedy, any refund or other remedy may be proportionate to the services that have already been provided, subject always to the Participant's statutory rights.

 

Depending on the circumstances, we may also offer a transfer, deferral, credit or other reasonable alternative which the Participant may choose to accept.

 

14.7 Other losses and expenses

We will not be responsible for losses or expenses arising from cancellation, abandonment or alteration of the Event where those losses were not reasonably foreseeable when the Agreement was entered into, or where they were not caused by a breach of contract or other legal duty for which we are responsible.

 

This may include, depending on the circumstances, costs incurred by Participants in relation to travel, accommodation or other personal arrangements.

 

Nothing in this clause excludes or limits liability which cannot lawfully be excluded or limited.

14.8 Participant insurance

Participants are encouraged to consider obtaining appropriate insurance to protect against losses arising from their inability to attend the Event, travel disruption, cancellation and other circumstances which may affect their participation.

 

The availability or absence of insurance does not affect any statutory rights a Participant may have against us.

15. PHOTOGRAPHY, FILMING AND MEDIA

15.1 The Event may be photographed, filmed, livestreamed, broadcast or otherwise recorded.

 

15.2 Images and recordings may include Participants, teams, spectators and the Event environment.

 

15.3 Subject to applicable law, we and organisations authorised by us may use Event imagery and recordings for legitimate purposes connected with the Event and our activities, including reporting, editorial content, promotion, publicity and historical archive.

 

15.4 Participants may take photographs and recordings for personal, non-commercial purposes provided this does not interfere with the Event, compromise safety or unreasonably infringe the rights of others.

 

15.5 Commercial photography, filming or exploitation of Event content may require our prior written permission.

 

16. PERSONAL DATA

16.1 We will process personal information relating to Participants in accordance with applicable data protection legislation and our Privacy Notice.

 

16.2 Personal information may be processed where reasonably necessary to:

• administer entries;

• stage and manage the Event;

• communicate important Event information;

• provide timing and results;

• manage safety and emergencies;

• administer insurance, where applicable;

• prevent fraud or misuse of entries; and

• meet our legal and regulatory obligations.

 

16.3 Certain health or medical information may be processed where necessary for Event safety and emergency medical purposes and in accordance with applicable data protection law.

 

16.4 We may publish Event results including information such as Participant name, team or club, category, lap count, position and finishing information.

 

16.5 Marketing communications will be managed separately in accordance with our Privacy Notice and applicable electronic-marketing and data-protection requirements.

 

16.6 Acceptance of these Conditions does not constitute consent to receive optional direct marketing.

 

17. LIABILITY

17.1 Nothing in these Conditions excludes or limits liability where it would be unlawful to do so.

 

17.2 In particular, nothing in these Conditions excludes or limits our liability for:

• death or personal injury caused by our negligence;

• fraud or fraudulent misrepresentation; or

• any other liability which cannot lawfully be excluded or limited.

 

17.3 Nothing in these Conditions excludes or restricts our statutory obligation to perform the Event services with reasonable care and skill.

 

17.4 Subject to clauses 17.1 to 17.3 and your statutory rights, we will not be responsible for losses which were not reasonably foreseeable when the Agreement was entered into or which arise from circumstances for which we are not legally responsible.

 

17.5 We are not responsible for loss of or damage to personal possessions except to the extent that such loss or damage results from our negligence or other breach of legal duty.

 

17.6 Participants are responsible for taking reasonable steps to secure and safeguard their own possessions, vehicles, tents, equipment and valuables.

 

17.7 Nothing in these Conditions affects your statutory rights as a consumer.

 

 

18. INSURANCE

18.1 We will maintain such organiser insurance as we reasonably consider appropriate for the Event and/or as required by the Venue, governing bodies or applicable law.

 

18.2 Our insurance does not necessarily provide Participants with personal accident, travel, cancellation, possessions or other individual insurance cover.

 

18.3 Participants are responsible for arranging any personal insurance they consider appropriate.

 

19. CHANGES TO THESE CONDITIONS AND EVENT RULES

19.1 We may make reasonable amendments to these Conditions or the Event Rules where necessary to:

• comply with law or regulatory requirements;

• respond to health and safety requirements;

• meet requirements imposed by the Venue or competent authorities;

• address material operational requirements; or

• clarify or correct provisions.

 

19.2 We will communicate any material change which significantly affects Participants where it is reasonably practicable to do so.

 

19.3 Changes will not retrospectively remove statutory rights which Participants already possess.

 

20. GENERAL

20.1 If any provision of these Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall continue in force.

 

20.2 A failure or delay by us in enforcing a provision of these Conditions does not waive our right to enforce that provision subsequently.

 

20.3 Except where applicable law provides otherwise, the Agreement is between you and Urban Mud Events Ltd and does not give any third party a right to enforce its terms.

 

20.4 These Conditions and the Agreement are governed by English law.

 

20.5 You and we agree that the courts of England and Wales will have jurisdiction, subject to any mandatory rights you may have as a consumer to bring proceedings elsewhere.

Transfer and deferral policy
